Provider Terms and Conditions

1. Definitions

• 1.1 "Adverse Event". Any undesirable experience associated with the use of a Product, whether or not considered related to the Product.
• 1.2 "Certificate of Analysis" or "COA". The document specifying identity, content, purity, potency, the country in which the bulk drug substance was originally manufactured, and other quality attributes of a Product lot.
• 1.3 "Manufacturing Defect". A defect causing a Product to fail to conform to COA specifications at the time of shipment.
• 1.4 "Products". The peptides, compounds, and other items manufactured or distributed by Peptide Pure LLC.
• 1.5 "Provider". The licensed healthcare professional or authorized representative purchasing Products.
• 1.6 "Bulk Drug Substance". Any substance intended for incorporation into a finished drug product and intended to furnish pharmacological activity or other direct effect, including an amino acid or peptide.

2. Peptide Pure LLC's Role as Manufacturer and Supplier Only

• 2.1 Manufacturer Status. Peptide Pure LLC is solely a manufacturer and supplier. Peptide Pure LLC does not practice medicine, provide clinical services, or maintain any provider-patient relationship.
• 2.2 No Clinical Involvement. Peptide Pure LLC expressly disclaims any involvement in or responsibility for: (a) selection of a Product for any patient, condition, or indication; (b) determination of dosing, administration routes, or protocols; (c) assessment of patient eligibility, contraindications, or risk factors; (d) monitoring of patient outcomes; (e) provision of informed consent; or (f) any clinical decision-making.
• 2.3 No Legal or Regulatory Advice. Peptide Pure LLC does not provide legal or regulatory advice. Provider is solely responsible for determining lawful use.
• 2.4 No Warranty Expansion. No statement in Product documentation or communications shall be construed as medical advice or a treatment recommendation.
• 2.5 No Representation of FDA Status. "Professional Use Only" is a labeling convention used by Peptide Pure LLC. It is not a designation, classification, approval, exemption, or safe harbor granted or recognized by the U.S. Food and Drug Administration. It does not make any Product an approved drug, a compounded drug, or a drug that may lawfully be administered to a human. Peptide Pure LLC makes no representation that any Product may lawfully be used in any particular manner, by any particular person, or in any particular jurisdiction.
• 2.6 Not a Compounding Facility. Peptide Pure LLC is not a 503A compounding pharmacy, a 503B outsourcing facility, a pharmacy, or a healthcare provider. Products are not compounded drug products and are not dispensed under a prescription.

3. Eligibility and Provider Representations

• 3.1 Licensing. Provider represents that Provider holds a current, active, unrestricted professional license authorizing the purchase and use of Products.
• 3.2 Scope of Practice. Provider represents that the purchase and use of Products falls within Provider's lawful scope of practice and that Provider has the necessary training and competence.
• 3.3 Compliance with Laws. Provider represents that Provider has reviewed all applicable federal, state, and local laws, including state medical practice acts, pharmacy laws, FDA regulations, informed consent requirements, and controlled substance regulations.
• 3.4 Annual Certification. Provider shall certify annually upon request that Provider's license remains current and unrestricted, and shall notify Peptide Pure LLC within five (5) business days of any restriction, suspension, surrender, revocation, or investigation affecting that license.
• 3.5 No Compounding Use Where Prohibited. Provider represents and warrants that Provider will not use, and will not permit any pharmacy or other person to use, any Product as a Bulk Drug Substance in compounding a drug for human use where such use is prohibited by federal or state law. Provider acknowledges that certain states prohibit the use of research-grade material in compounding absent an institutional review board approved study, and that a Product that does not appear on FDA's list of bulk drug substances eligible for use in compounding under section 503A is not eligible for such use.
• 3.6 No Resale to Consumers. Provider represents and warrants that Provider will not resell, distribute, or transfer any Product to any person who is not a licensed healthcare professional, and will not sell any Product direct to a consumer or patient other than in the course of Provider's own lawful clinical practice.

Peptide Pure LLC verifies professional licensure before activating ordering access and may deny, suspend, or revoke access at any time. Account holders must be at least 18 years of age and provide truthful, accurate information.

4. Provider's Sole Responsibilities

• 4.1 Professional Judgment. Provider is solely responsible for: (a) determining appropriateness for any patient; (b) selecting products, doses, and protocols; (c) evaluating patient eligibility and risk factors; (d) monitoring outcomes; (e) obtaining informed consent; (f) maintaining records; and (g) complying with all laws and professional standards.
• 4.2 Informed Consent. Provider shall obtain written informed consent from each patient before administration, disclosing that Products are not FDA-approved for any indication and have not been evaluated by FDA for safety or efficacy.
• 4.3 Record Keeping. Provider shall maintain complete records of all Products purchased, patients treated, doses administered, and outcomes observed.
• 4.4 Adverse Event Reporting. Provider shall report Adverse Events within 24 hours to info@peptidepure.com with: product name, lot number, patient demographics without identifying information, description, and treatment provided. Reporting to Peptide Pure LLC does not satisfy and does not replace any reporting obligation Provider owes to FDA, to any state agency, or to any licensing board.
• 4.5 Labeling Integrity. Provider shall not relabel, repackage, remove, alter, or obscure any Product label, lot identifier, country of origin statement, or Professional Use Only legend, and shall not represent any Product as FDA-approved, as compounded, or as equivalent to any branded pharmaceutical product.
• 4.6 Records Retention. Provider shall maintain all records relating to the acquisition, examination, and testing of each Product for not less than two (2) years after the expiration date of the last lot, and shall produce those records to Peptide Pure LLC or to a regulator upon request. Provider acknowledges that certain states impose this obligation directly on any person engaged in the sale, transfer, or distribution of drugs used in compounding.

5. Product Status and Restrictions

• 5.1 Professional Use Only. Products are labeled "For Professional Use Only" and are NOT FDA-approved for any specific indication.
• 5.2 No Unauthorized Resale. Provider shall not sell, distribute, or transfer Products to any third party without prior written consent, subject in all cases to Section 3.6.
• 5.3 Storage and Handling. Provider shall store and handle Products per label and COA specifications.
• 5.4 Certificate of Analysis. Peptide Pure LLC shall provide a COA for each Product lot upon request. Each COA states identity, content, and the country in which the bulk drug substance was originally manufactured.
• 5.5 Identity and Content Testing. Peptide Pure LLC conducts or obtains identity and content testing on each lot and rejects any lot whose assay does not match its label. Provider is nonetheless responsible for its own verification where its scope of practice, its licensing board, or applicable state law requires it.
• 5.6 Supply Chain. Peptide Pure LLC represents that the bulk drug substances used in the Products are obtained from establishments registered with FDA as human drug establishments, and maintains chain of custody documentation from synthesis through final labeling.
• 5.7 No Administration Supplies. Peptide Pure LLC does not sell, bundle, or supply bacteriostatic water, sterile water for injection, syringes, needles, or reconstitution kits with any Product, and provides no reconstitution, dilution, dosing, or administration instructions.

6. Ordering and Payment

All orders are subject to acceptance. Payment is due upon receipt of invoice unless otherwise agreed. Prices are in U.S. dollars and are subject to change with written notice. Peptide Pure LLC may decline or suspend any order, including where it has reason to believe a Product will be used in a manner inconsistent with these Terms.

7. Limitation of Liability

• 7.1 PEPTIDE PURE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• 7.2 TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE OF THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
• 7.3 NO WARRANTIES EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT CONFORMANCE TO COA SPECIFICATIONS AT THE TIME OF SHIPMENT.
• 7.4 Nothing in this Section limits any liability that cannot be limited or excluded under applicable law.

8. Indemnification

Provider agrees to indemnify, defend, and hold harmless Peptide Pure LLC and its owners, officers, directors, employees, and agents from all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from: (a) use or misuse of Products; (b) treatment of patients; (c) violation of these Terms, including any breach of the representations in Sections 3.5 and 3.6; (d) violation of any law; or (e) any third-party claim.

9. Privacy and Protected Health Information

• 9.1 Peptide Pure LLC processes personal information in accordance with its Privacy Policy, which is incorporated by reference.
• 9.2 Peptide Pure LLC does not request, and Provider shall not transmit to Peptide Pure LLC, any protected health information or any information identifying a patient. Adverse Event reports under Section 4.4 shall be submitted with patient demographics only and without identifying information.
• 9.3 Peptide Pure LLC is not a covered entity or a business associate under the Health Insurance Portability and Accountability Act. Provider is solely responsible for its own HIPAA compliance and for compliance with any applicable state health data or consumer health data statute.

10. Dispute Resolution

• 10.1 Good Faith Negotiation. The parties shall attempt resolution through good faith negotiation for thirty (30) days following written notice.
• 10.2 Mediation. If unresolved, the parties shall attempt non-binding mediation in Ventura County, California.
• 10.3 Binding Arbitration. Any remaining dispute shall be resolved by binding arbitration administered by JAMS in Ventura County, California.
• 10.4 Governing Law. Laws of the State of California, without regard to conflict of laws provisions.
• 10.5 Class Action Waiver. Disputes shall be conducted only on an individual basis. If this Section is found unenforceable as to any claim or request for relief, that claim or request shall be severed and heard in a court of competent jurisdiction, and the remainder of Section 10 shall continue to apply.

11. Term and Termination

These Terms are effective upon the first order and continue until terminated. Either party may terminate on thirty (30) days' written notice. Peptide Pure LLC may terminate immediately for any violation of these Terms, upon any restriction or loss of Provider's license, or upon any indication that Products are being used or transferred in a manner inconsistent with Sections 3.5 or 3.6. Sections 2, 4, 5.5, 7, 8, 9, and 10 survive termination.

12. General Provisions

• 12.1 Entire Agreement. These Terms, together with the Privacy Policy, the Refund and Order Policy, and each order acknowledgment, constitute the entire agreement between the parties concerning its subject matter and supersede all prior agreements and understandings, written or oral.
• 12.2 Severability. If any provision is held unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions continue in full force.
• 12.3 Waiver. No failure or delay in enforcing any provision operates as a waiver. A waiver is effective only if in writing and signed by the waiving party, and applies only to the instance specified.
• 12.4 Assignment. Provider may not assign or transfer these Terms or any right or obligation under them, by operation of law or otherwise, without Peptide Pure LLC's prior written consent. Peptide Pure LLC may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of substantially all of its assets.
• 12.5 Force Majeure. Neither party is liable for any failure or delay in performance caused by an event beyond its reasonable control, including a natural disaster, epidemic, labor disruption, carrier failure, supply chain interruption, government action, or regulatory order. This Section does not excuse any payment obligation.
• 12.6 Notices. Notices to Peptide Pure LLC shall be sent to info@peptidepure.com and to the mailing address provided on request at info@peptidepure.com. Notices to Provider shall be sent to the email and mailing address in Provider's account. Notice is effective on receipt, or on the next business day if sent by email after 5:00 p.m. in the recipient's time zone.
• 12.7 Modification. Peptide Pure LLC may modify these Terms on written notice to Provider. A modification takes effect on the date stated in the notice, which shall be not less than thirty (30) days after the notice, and applies to orders placed on or after that date. Provider's continued ordering after the effective date constitutes acceptance. The version of these Terms in effect on the date of an order governs that order.
• 12.8 Relationship of the Parties. The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship, and neither party may bind the other.
• 12.9 No Third-Party Beneficiaries. These Terms confer no rights on any person other than the parties, except that Section 8 extends to the indemnified persons named in it.
• 12.10 Counterparts and Electronic Acceptance. Acceptance may be given electronically, and an electronic record of acceptance has the same effect as a signed original.

13. Regulatory Acknowledgment

Provider acknowledges that the regulatory environment governing peptide products is changing rapidly at both the federal and state level, that federal criminal enforcement in 2026 has included charges against a licensed prescriber arising from the receipt and distribution of misbranded peptides, and that such matters have been investigated jointly by FDA's Office of Criminal Investigations and state professional licensing authorities. Provider is solely responsible for obtaining its own legal advice regarding the lawfulness of its intended use of any Product. Peptide Pure LLC encourages Provider to consult qualified counsel before purchase.

Provider Acknowledgment

BY PURCHASING PRODUCTS, PROVIDER ACKNOWLEDGES: (1) PRODUCTS ARE FOR PROFESSIONAL USE ONLY AND ARE NOT FDA-APPROVED FOR ANY INDICATION; (2) "PROFESSIONAL USE ONLY" IS NOT AN FDA DESIGNATION AND CONFERS NO REGULATORY STATUS; (3) PROVIDER IS SOLELY RESPONSIBLE FOR DETERMINING LAWFUL USE; (4) PEPTIDE PURE LLC PROVIDES NO CLINICAL GUIDANCE; (5) PROVIDER WILL NOT USE ANY PRODUCT IN COMPOUNDING WHERE PROHIBITED BY LAW AND WILL NOT RESELL TO CONSUMERS; (6) ALL SALES ARE FINAL ONCE SHIPPED; AND (7) PROVIDER IS BOUND BY THESE TERMS.

Website Use: Account Security

Provider is responsible for keeping account credentials confidential and for all activity under the account. Provider agrees to use a strong, unique password, not to share credentials with any third party, and to notify Peptide Pure LLC immediately at info@peptidepure.com of any unauthorized access. Accounts are non-transferable.

Website Use: Acceptable Use

The website may be used only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the website for any unlawful purpose or in violation of any applicable law or regulation;
• Misrepresent your identity, professional license, or affiliation, or provide false or misleading information;
• Access or attempt to access any portion of the website to which you are not authorized;
• Interfere with or disrupt the website, or use any bot, scraper, or automated system to access it;
• Probe, scan, or test the vulnerability of the website or breach any security measure;
• Transmit any virus, malware, or harmful code, or harvest information without authorization;
• Reproduce, distribute, or publicly display website content without authorization; or
• Reverse engineer, decompile, or disassemble any software or technology used on the website.

The website and all content, features, and functionality, including text, graphics, logos, images, product specifications, and their design, selection, and arrangement, are owned by or licensed to Peptide Pure LLC and are protected by United States and international intellectual property laws. "Peptide Pure," "PeptidePure™," and related names, logos, and marks are trademarks of Peptide Pure LLC and may not be used without prior written permission. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access the website for your professional purchasing use. All rights not expressly granted are reserved.
