1. Acceptance of Terms

By accessing or using the Website, you represent that you have read, understood, and agree to be bound by these Terms. If you are accessing the Website on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms. Peptide Pure reserves the right to modify these Terms at any time by posting the updated Terms with a new "Last Updated" date. Your continued use after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Nature of Products — Research Use Only

All peptides, biologics, and related compounds offered through Peptide Pure are sold for laboratory, research, and analytical purposes only. They are NOT approved by the U.S. Food and Drug Administration (FDA) and are NOT intended to diagnose, treat, cure, or prevent any disease or condition.

• Products are labeled and sold as "Research Use Only" and are not for human or animal consumption.
• Statements made on this Website have not been evaluated by the FDA.
• Peptide Pure makes no therapeutic, safety, or efficacy claims regarding any product for any use, indication, or patient.
• Peptide Pure is a supplier of research materials. Peptide Pure is not a compounding pharmacy as defined under Section 503A of the Federal Food, Drug, and Cosmetic Act, and is not an outsourcing facility as defined under Section 503B.
• Any decision to use any product is made solely by a licensed professional exercising independent judgment and is the sole responsibility of that professional.

3. Professional Use Only; No Medical Advice

The Website and its content — including product descriptions, specifications, protocols, and technical or scientific information — are provided for informational and professional-education purposes only and do not constitute:

• Medical, clinical, or treatment advice;
• Recommendations for any particular patient, condition, or use;

4. Eligible Users & Credentialing

Access to account registration, pricing, and product ordering is restricted to:

• Licensed physicians, physician assistants, nurse practitioners, naturopathic doctors, chiropractors, and other duly licensed healthcare professionals authorized within their scope of practice and state of licensure;
• IRB-approved research sites operating under a valid observational protocol; and
• Authorized administrators acting on behalf of a licensed professional.

To register you must be at least 18 years of age, hold a valid and unrestricted professional license, and provide truthful and accurate information. Peptide Pure reserves the right to verify credentials, NPI numbers, and state licensure at any time, and to deny, suspend, or revoke access at its sole discretion, with or without notice.

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to create a strong, unique password, not to share your credentials with any third party, to notify Peptide Pure immediately of any unauthorized access, and to log out at the end of each session. Accounts are non-transferable.

6. Acceptable Use

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Website for any unlawful purpose or in violation of any applicable law or regulation;
• Misrepresent your identity, professional credentials, or affiliation, or provide false or misleading information;
• Access or attempt to access any portion of the Website to which you are not authorized;
• Interfere with or disrupt the Website, or use any bot, scraper, or automated system to access it;
• Probe, scan, or test the vulnerability of the Website or breach any security measure;
• Transmit any virus, malware, or harmful code, or harvest information without authorization;
• Reproduce, distribute, or publicly display Website content without authorization; or
• Reverse engineer, decompile, or disassemble any software or technology used on the Website.

You agree to comply with all applicable federal, state, and local laws and regulations, including those governing professional licensing and the purchase and use of research materials.

7. IRB Participation & Compliance

Clinicians who enroll in the affiliated observational research framework agree to:

• Enroll participants under current IRB-approved informed consent;
• Follow the applicable IRB-approved protocol's data-collection and adverse-event reporting requirements;
• Submit required data within the timelines specified by the protocol; and
• Accept oversight by the applicable central IRB.

IRB participation is voluntary. Enrollment does not create an employment, agency, or joint-venture relationship with Peptide Pure LLC or any affiliated entity.

8. Product Information, Sourcing & Quality

Peptide Pure sources raw actives under ISO 9001-certified quality systems, with DMF- or CEP-backed API where available, and performs lyophilization and fill-finish under cGMP-compliant systems, with batch-level Certificates of Analysis. Peptide Pure attempts to provide accurate product descriptions and specifications but does not warrant that any description, pricing, image, or other content is accurate, complete, current, or error-free. Product images are illustrative only.

• All prices are subject to change without notice, and Peptide Pure is not responsible for typographical errors.
• Orders are not binding until confirmed by Peptide Pure in writing. Payment must be received in cleared funds prior to shipment.
• Peptide Pure reserves the right to modify, discontinue, limit, or cancel the availability of any product or order at any time, including for supply constraints, compliance concerns, or suspected misuse, and does not guarantee availability of any product.

9. Shipping, Import & Customs

Buyer assumes all risk for import compliance, customs clearance, and applicable local regulations upon shipment. Peptide Pure is not liable for delays, seizures, or losses caused by customs authorities. Domestic and international regulatory requirements are the sole responsibility of the ordering professional or institution.

10. Intellectual Property

The Website and all content, features, and functionality — including text, graphics, logos, images, product descriptions, protocols, proprietary formulations, and the design, selection, and arrangement thereof — are owned by or licensed to Peptide Pure LLC and are protected by United States and international intellectual-property laws. "Peptide Pure," "PeptidePure™," and related names, logos, and marks are trademarks of Peptide Pure or its affiliates and may not be used without prior written permission. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access the Website for your professional use only. All rights not expressly granted are reserved.

11. Disclaimers

THE WEBSITE AND ALL CONTENT, FEATURES, AND FUNCTIONALITY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PEPTIDE PURE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

• Peptide Pure does not warrant that the Website will be available, uninterrupted, secure, or error-free, or that the content is accurate, complete, current, or reliable for any purpose.
• Peptide Pure makes no warranty or representation regarding the safety, efficacy, regulatory status, or appropriateness of any product for any use, indication, or patient.
• The Website may link to third-party resources provided for convenience only; Peptide Pure is not responsible for third-party content, and your use of third-party sites is at your own risk.
• Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions the above exclusions apply to the extent permitted by law.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PEPTIDE PURE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE OR ANY PRODUCT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT PEPTIDE PURE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

• TO THE FULLEST EXTENT PERMITTED BY LAW, PEPTIDE PURE'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID TO PEPTIDE PURE FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING IT.
• These limitations reflect a reasonable allocation of risk, form an essential basis of the bargain, and apply even if any limited remedy fails of its essential purpose.
• Some jurisdictions do not allow certain limitations; in such jurisdictions the above applies to the extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Peptide Pure LLC and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Website or any product;
• Your violation of these Terms;
• Your violation of any applicable law, regulation, or third-party right;
• Any content or information you submit to the Website; or
• Any clinical decision, patient outcome, or use of any product by you or any person acting on your behalf.

Peptide Pure reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully in such defense.

14. Privacy & Data Use

Your use of the Website is governed by our Privacy Policy, which is incorporated by reference. Peptide Pure collects and processes account, credentialing, and order information for business operations and compliance purposes.

• Clinicians participating in observational registry protocols consent to de-identified data aggregation for research purposes in accordance with the applicable IRB protocol.
• No patient-identifiable data is transmitted to Peptide Pure without express consent.
• Use of any PeptidePure™ data-capture tools is subject to a separate Data Use Agreement.

15. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or related to the Website or any product shall be governed by the laws of the State of California, without regard to conflict-of-law principles. Any such dispute shall be resolved by binding arbitration administered by JAMS in Ventura County, California, before a single arbitrator, whose decision shall be final and binding; judgment on the award may be entered in any court of competent jurisdiction.

• WAIVER OF JURY TRIAL: You and Peptide Pure each waive any right to a jury trial in any proceeding arising out of or related to these Terms or the Website.
• CLASS ACTION WAIVER: All proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action or class arbitration.
• Any claim must be filed within one (1) year after it arose, or it is forever barred.
• Notwithstanding the foregoing, Peptide Pure may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

16. Termination

Peptide Pure may suspend or terminate your access to the Website at any time, with or without cause or notice, effective immediately. Peptide Pure may also modify, suspend, or discontinue the Website or any portion at any time without notice. Upon termination, your right to access the Website ceases, and all provisions that by their nature should survive — including Sections 10 through 15 — shall survive. Peptide Pure shall not be liable to you or any third party for any termination, modification, suspension, or discontinuation.

17. General Provisions

These Terms, together with the Privacy Policy and any additional agreements you enter into with Peptide Pure, constitute the entire agreement regarding the Website and supersede all prior agreements. If any provision is found invalid or unenforceable, it shall be modified to the minimum extent necessary and the remaining provisions shall continue in full force. Peptide Pure's failure to enforce any right is not a waiver. You may not assign these Terms without Peptide Pure's prior written consent; Peptide Pure may assign them to any affiliate or successor. These Terms create no third-party beneficiary rights. Peptide Pure shall not be liable for any failure or delay due to circumstances beyond its reasonable control. By using the Website, you consent to receiving electronic communications, which satisfy any legal requirement that such communications be in writing.
